TERMS

Terms.

Plain terms for using derestricted.com and for buying from it. Part A applies to everyone. Part B covers the DERESTRICTED AI Prediction League. Part C covers DERESTRICTED Trends, which is sold to businesses only. Last updated 8 October 2026.

Part A · For everyone

A1 · Who you are dealing with

The site is operated by Piers Spencer-Phillips, trading as DERESTRICTED, a sole trader, Tannenstrasse 7, 82049 Pullach im Isartal, Germany (see the Impressum). "We" below means him.

A2 · Nothing here is advice

The Colour Index measures the colours brands and shops put on sale; it tells you what the market did, not what will sell. A colour concept is a creative proposal. A League forecast is a model's opinion, recorded so it can be scored. Nothing on this site is financial, investment, betting, legal, medical or any other kind of advice. Decisions you make with it are yours.

A3 · Accounts

An account is tied to an email address you control. Keep sign-in links to yourself; anyone with a valid link can sign in as you for twenty minutes. You can close your account at any time by writing to us; the privacy notice says what is deleted and what stays.

A4 · Our content

The site, the Colour Index and its counts, colour concepts, the League's sealed record, briefs and scoring are ours and protected by copyright and database law. You may read them, and quote individual figures with attribution to DERESTRICTED.

Without our written permission, you may not:

  • copy them in bulk by machine, scrape them or extract them;
  • resell them;
  • present them as your own;
  • use Trends content to train or feed an AI model.

For derestricted.com/trends and the Colour Index we reserve the right to text and data mining under § 44b (3) UrhG. The League's record is open to machines as described in Part B.

A5 · Availability and changes

This is a small, live, evolving service. We aim to keep it up, and we tell you on the methodology pages when rules change. We do not promise uninterrupted availability or that any feature stays as it is.

A6 · Law and disputes

German law applies. If you are a consumer, the mandatory consumer protections of your country of residence apply too. If you are a merchant, a legal entity under public law or have no general place of jurisdiction in Germany, the courts of Munich have jurisdiction. We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board (§ 36 VSBG); we would rather sort it out by email.

A7 · Changes to these terms

We may update these terms, and the date at the top tells you when. Changes apply to purchases made after the change. A running Trends subscription keeps the terms it started on until it renews.

Part B · The AI Prediction League

B1 · What the service is

The League puts questions about the future to a panel of AI models, records their forecasts under seal before the outcome exists, and scores them when the outcome is known. When you ask the panel, you buy one run of your question through the panel. You get each model's forecast and reasoning, a written brief when the forecasts open, and a second brief and the scores when the question settles. The forecasts are produced by third-party AI models; we do not edit them, and we do not vouch for them. The site takes no wagers, holds no stakes and pays no prizes.

B2 · Asking a question

A question must be:

  • about a future event or a fact not yet public;
  • settleable from a public source by a date within ten years;
  • lawful.

Our check may reword your question so it can settle; you approve the wording before anything runs. Do not include personal data about yourself or anyone else. Public questions join the open record permanently, with your name only if you entered one. Private questions are visible to anyone with the link, which is unguessable but not secret once shared. We may decline or remove a question that breaks these terms; if it was paid for and had not run, we refund it.

B3 · Prices and payment

Prices are shown before you pay, in euros, with VAT included. Payment is by card through Stripe. A single question is paid once, and a decision pack is paid once for all the questions in it. Pro is a monthly subscription that renews each month until you cancel it, and cancelling takes effect at the end of the paid month. Unused Pro questions do not carry over. Prices may change; a change never affects a purchase already made or a subscription month already paid.

B4 · Cancelling Pro

You can cancel Pro at any time, without signing in, with the button "Verträge hier kündigen · Cancel contracts here" at the foot of every League page. You can also cancel from your account (Manage billing) or by email. We confirm the cancellation by email straight away.

B5 · Your right of withdrawal

If you buy as a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day the contract is concluded.

To exercise the right of withdrawal, you must tell us (Piers Spencer-Phillips, DERESTRICTED, Tannenstrasse 7, 82049 Pullach im Isartal, Germany, hello@derestricted.com, +49 151 745 069 74) of your decision to withdraw by a clear statement. You can do this by letter or by email, or with the button "Vertrag widerrufen · Withdraw from contract" at the foot of every League page. You may use the model form below, but you do not have to. To meet the deadline, it is enough to send your notice before the withdrawal period has expired.

Effects of withdrawal. If you withdraw, we refund all payments we received from you without undue delay, and at the latest within fourteen days of the day we receive your notice. We use the same means of payment you used, unless we expressly agree otherwise, and you are not charged any fee for the refund. If you asked us to begin the service during the withdrawal period, you pay an amount in proportion to what was provided until you told us you were withdrawing, compared with the full service in the contract.

When the right ends early. For a single question or a decision pack, the right of withdrawal ends once the panel has fully run your question (§ 356 (4) BGB). This only applies if, at checkout, you expressly asked us to begin at once and confirmed that you know you lose the right once the run is complete. If the panel fails to run your question, we refund the payment in full without your asking.

Model withdrawal form. (Complete and return this form only if you wish to withdraw from the contract.)
To Piers Spencer-Phillips, DERESTRICTED, Tannenstrasse 7, 82049 Pullach im Isartal, Germany, hello@derestricted.com:
I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service (*):
Ordered on (*) / received on (*):
Name of consumer(s):
Address of consumer(s):
Signature of consumer(s) (only if this form is notified on paper):
Date:
(*) Delete as appropriate.

B6 · The record and your use of it

Public forecasts, scores and reasoning are published for anyone to read, quote and analyse, with attribution to the League, including through the machine endpoints (llms.txt, agent.md, the API). Without written permission, you may not copy the record in bulk, resell it or present it as your own. The models' outputs belong to their providers under the providers' terms. The sealed record, briefs and scoring are ours. If we stop the League, paid questions that have not run are refunded, and the public record stays online or is handed to an open archive.

B7 · Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For ordinary negligence, we are liable only for breach of an essential contractual duty, and then only for the foreseeable, typical loss. We are never liable for loss from acting on a forecast. Nothing here limits the rights a consumer has by law.

C1 · Who can buy

Trends plans and services are sold only to businesses (Unternehmer, § 14 BGB) buying for their trade or profession. By buying, you confirm that you buy for a business. We may ask for a company name, a VAT number or a register entry, and we may decline an order. Because these are business contracts, the consumer right of withdrawal does not apply.

C2 · What you buy

What each plan includes, how many markets and seasons it covers and when reports arrive is described on the pricing page at the time you buy, and that description is part of your contract. The Colour Index is free and needs no contract.

C3 · Prices and payment

Prices are in euros, net of VAT. German VAT is added at the statutory rate. A business in another EU country with a valid VAT number is invoiced without VAT under the reverse charge, and businesses outside the EU are invoiced as the law provides. Annual plans are paid in advance, by card through Stripe or by invoice, payable within fourteen days.

C4 · Term and renewal

An annual plan runs for twelve months from the day it starts. It renews for a further twelve months unless you or we cancel it in text form (an email is enough) at least one month before the end. You can also cancel from your account. If we change the price, we tell you at least two months before the renewal date, and you may cancel before the new price applies.

C5 · How you may use what you receive

Reports, the dashboard, data exports and concepts are licensed to your company for its own internal use. Your employees, and contractors working for you, may use them too. You may quote individual figures in your own presentations and publications with "Source: DERESTRICTED Colour Index".

Without our written permission, you may not:

  • pass reports, exports or log-ins to anyone outside your company;
  • publish them in whole;
  • resell them;
  • feed them into an AI model or a dataset that others can reach.

Your concepts. Once paid for, the colours, palettes and directions in your concepts are yours to use on your products without limit. A colour itself belongs to nobody. The concept documents stay ours, licensed to you as above. The mood pictures in a concept are made with an image model; use them as references for your team, not as artwork for products or advertising.

C6 · Your brief and your material are confidential

We treat your briefs, your ranges and anything you upload as confidential. We use them only to make your concepts and reviews, never in the public count, and we never show them to other customers. To make concepts we send the brief's text, without your name or company contact, to AI model providers through OpenRouter, using only providers that do not keep or train on it (see the privacy notice). A brief is never made public unless you choose so. You confirm that you may give us what you upload.

C7 · What the count is

The Colour Index is a measurement of products put on sale on brands' and shops' own websites and in their catalogues. It is published under fixed rules, set out on the methodology page. Our method is careful and every figure can be traced to its source, but a count can still miss a product or misread one. If you find an error, tell us and we correct it in the next count. We do not promise that the count is complete, or that any colour will sell.

C8 · Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and under any guarantee we gave. For ordinary negligence, we are liable only for breach of an essential contractual duty, limited to the foreseeable, typical loss. In any case that liability is limited to the fees you paid for the plan in the twelve months before the event. We are not liable for the outcome of colour, range or buying decisions you make with Trends.

C9 · Ending early

Either side may end a plan without notice for good cause. If we stop Trends, we refund the unused part of any fees paid in advance.
